	주택임대차보호법 제4조 제1항에 의거하면 기간의 정함이 없는경우와 2년미만으로 정한경우에는 2년으로 봅니다. 임대차의 존속기간이 2년임을 주장하시면 임대인(집주인)은 보증금 반환을 거절할 수 없습니다. 그리고 그 임대차 기한이 종료한 후에도 보증금을 반환받을 때까지는 임대차관계가 존속하는것으로 보기 때문에 돈을 돌려받을때까지 집에서 계속 거주할수있습니다

	보증금 받지도 못하고 방빼고 딴데로 이사가셔서 그쪽으로 전입신고하면(이사는 가셔도 되는데 전입신고는 하지마세요) 대항력 상실하기 때문에 보증금 반환받기 어려워질수있습니다.

	일단 통상 2년으로 보는 게 맞긴 한데요, 그게 계약 해지 통보를 안하면 연장하는 걸로 보는데... 계약 만료일 1개월 전까지는 해지를 통보해야 합니다. 만약 1개월 전까지 통보하지 않는다면 계약을 연장하는 것으로 봐서, 이후에 해지하겠다고 말하면 해지까지 3개월의 시한이 생기는 것으로 압니다. 즉 집주인이 배려하지 않으면 3개월은 더 살아야 한다는 이야기. 일단 대충 순서라고 하면 집주인에게 이야기를 하고, 그에 따라서 새 집을 가계약이라도 걸어놓고 이런 정도겠네요.
